Terms of Service

1. Scope

These Terms of Service (hereinafter "Terms") apply to the use of the platform [DOMAIN] (hereinafter "Platform" or "Service") for AI-assisted generation of Twitch emotes.

2. Contract Formation and Registration

2.1 Registration is required to use the service. By registering, the user makes a binding offer to conclude a user agreement.

2.2 The contract is concluded by activation of the user account by the operator.

2.3 The user is obliged to provide truthful and complete information during registration.

2.4 The user must be at least 18 years old. For minor users, consent from legal guardians is required.

3. Service Description

3.1 The platform enables AI-assisted generation of Twitch emotes based on text descriptions or uploaded images.

3.2 Credits are required to use the generation function. Credits can be purchased for a fee.

3.3 The operator offers various plans:

  • Free: 10 credits upon registration, 5 new credits daily
  • Streamer: $19.99/month, 50 credits daily
  • Pro: $39.99/month, 100 credits daily
  • Agency: $79.99/month, 200 credits daily

3.4 The operator reserves the right to change plans and prices. Existing customers will be informed at least 30 days before changes take effect.

3.5 The operator does not guarantee any specific availability of the platform. Maintenance work may lead to temporary outages.

4. Credits and Payment Terms

4.1 Credits do not expire and can be used indefinitely as long as the account is active.

4.2 For paid plans, billing occurs monthly in advance via PayPal subscription.

4.3 Credits can additionally be purchased as one-time purchases. Purchased credits do not expire.

4.4 Upon cancellation of a subscription, already purchased credits remain in the account and can continue to be used.

4.5 Refund of credits is excluded, except in cases of demonstrably defective service by the operator.

5. Copyrights and Usage Rights

5.1 The generated emotes are created by Artificial Intelligence. The user receives a simple, spatially and temporally unlimited right of use for the generated emotes.

5.2 The user is entitled to use the generated emotes for commercial and non-commercial purposes, in particular:

  • As Twitch emotes
  • On social media
  • For merchandise (t-shirts, stickers, etc.)
  • In streaming overlays

5.3 Transfer of emotes to third parties for unlimited use is prohibited.

5.4 Emotes from Free tier users contain a watermark. This may not be removed. For paid plans, watermarks are omitted.

5.5 The operator stores generated emotes in the user's account for 30 days. After that, they may be automatically deleted. The user is responsible for backing up their emotes.

6. User Obligations

6.1 The user is obliged to use the platform only for legal purposes.

6.2 In particular, it is prohibited to generate content that:

  • Violates applicable law
  • Depicts violence, hate, or discrimination
  • Shows pornographic or harmful-to-minors content
  • Violates copyrights, trademark rights, or personal rights of third parties
  • Is offensive, defamatory, or slanderous

6.3 The user is obliged to keep their password secret and to inform the operator immediately if unauthorized access to the account is suspected.

6.4 The user is obliged not to use automated systems (bots) that violate the fair use policy.

7. Suspension and Termination

7.1 The operator reserves the right to suspend or delete accounts without prior notice in case of violation of these Terms.

7.2 The user can delete their account at any time via account settings.

7.3 Subscriptions can be cancelled at any time at the end of the billing period. Refund for already paid periods does not occur.

7.4 Upon suspension or deletion of the account, all credits expire. Refund does not occur, except in case of suspension by the operator without fault.

8. Liability

8.1 The operator is liable without limitation for damages from injury to life, body, or health, as well as for damages based on intent or gross negligence.

8.2 For slightly negligent breaches of duty, the operator is only liable for violation of essential contractual obligations. In this case, liability is limited to typical, foreseeable damage.

8.3 The operator assumes no liability for the legality of content generated by the user. The user is solely responsible for checking legal permissibility.

8.4 The operator is not liable for data loss if this could have been prevented by regular backups by the user.

9. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal:

Withdrawal Instructions

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of contract conclusion.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Exclusion of the right of withdrawal:
The right of withdrawal expires prematurely for contracts for the delivery of digital content if the provider has begun with the execution of the contract after the consumer has expressly consented and confirmed their knowledge that they lose their right of withdrawal by giving their consent with the beginning of contract execution.

10. Changes to the Terms

10.1 The operator reserves the right to change these Terms at any time.

10.2 Users will be informed of changes by email. The changes are deemed approved if the user does not object within 30 days of receipt of the change notification.

10.3 In case of objection, the operator is entitled to terminate the contractual relationship.

11. Final Provisions

11.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

11.2 Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.

11.3 The place of jurisdiction for all disputes arising from this contract is [CITY], provided the user is a merchant, legal entity under public law, or special fund under public law.
